Tenant-Based Rental Assistance Programs
Units Occupied/To Be Occupied By A Family With a Child Under Age Six: Provision of Pamphlet by the owner Visual Assessment by the designated party* during initial and periodic inspections Paint Stabilization using safe work practices before occupancy or, if unit is already occupied, within 30 days after Visual Assessment report Clearance by the designated party* Provision of Notice of hazard reduction activity, including clearance results, to occupants Ongoing Lead-Based Paint Maintenance
Superseding Requirement: Units that Are or Have Been Occupied by a Child Under Age Six Who Has an Environmental Intervention Blood Lead Level (EIBLL): Report to the public health department within five days the name and address of an EIBLL case reported by any other medical health care professional Risk Assessment by the designated party* within 15 days after notice or verification of EIBLL case Provision of Notice of the results of the risk assessment to occupants Interim Controls using safe work practices or Abatement within 30 days after risk assessment report Clearance by the designated party* Provision of Notice of hazard reduction activity and results to occupants
Units Occupied by a Family with No Child Under Age Six: No requirements (except where owner has pending obligation for lead hazard evaluation and control in response to an EIBLL child)
Ongoing Requirement of Tenant-Based Rental Assistance Programs: Report to the public health department an updated list of the addresses of units receiving assistance (at least quarterly) At least quarterly, attempt to obtain from the public health department a list of the names and/or addresses of children under the age of six with an identified EIBLL; match the EIBLL list with the rental assistance program's list (unless the public health department makes this comparison), and respond to the matches of any EIBLL children who live in units receiving assistance.
*The designated parties responsible for visual assessment (or, where an EIBLL child has resided, risk assessment) and clearance for tenant-based programs are:
- For Section 8 tenant-based certificate and voucher programs: the public housing authority
- For HOPWA and Shelter Plus Care programs: the grantee
- For HOME program: the participating jurisdiction.
- For Indian Housing Block Grant program: the IHBG recipient
