Housing Units Affected by the Rule:

Generally, the rule covers housing built before 1978 that is federally owned and being sold, federally subsidized, covered by an application for FHA multifamily mortgage insurance, or subject to rehabilitation funded by federal grants, obligations, and contracts awarded after 9/15/00.

Exemptions:

There are several types of exemptions:

  • Zero-bedroom units (efficiency, SRO)
  • Housing exclusively for elderly or disabled, provided a child under the age of six does not reside and is not expected to reside in the property
  • Property certified free of lead-based paint
  • Vacant property pending demolition
  • In rehab and other work that will not disturb paint
  • Emergency actions immediately necessary to safeguard against imminent danger to human life, health or safety
